Scope

These Terms and Conditions govern all purchases made on the XYPRA website (xyprasport.com). By placing an order, you accept these terms without reservation. XYPRA reserves the right to modify these terms at any time.

Products and information

XYPRA sells premium padel rackets (MODUS and IMPERIA models). Product descriptions, specifications, images and prices are provided for informational purposes and are subject to change.

Prices are in euros and include VAT.

Orders

Orders constitute an offer to purchase, subject to acceptance by XYPRA. You must provide accurate and complete information (name, address, email, phone number). XYPRA may refuse orders that appear fraudulent or incomplete and will notify you immediately.

Payment

We accept payments by Visa, Mastercard, American Express and PayPal. Payment must be received before order processing. All payments are processed securely via Shopify and PayPal. XYPRA does not store payment information.

Intellectual property

All website content (texts, images, logos, designs) belongs to XYPRA or its licensors. Unauthorised reproduction is prohibited.

Legal guarantees

In accordance with Articles L217-4 et seq. of the French Consumer Code, XYPRA is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The statutory guarantee of conformity applies for a period of two years from the date of delivery.

In the event of a lack of conformity, the consumer may choose between repair or replacement of the goods. If these solutions prove impossible or disproportionate, the consumer may obtain a price reduction or cancellation of the contract.

Furthermore, in accordance with Articles 1641 et seq. of the French Civil Code, XYPRA is liable for hidden defects in the product sold that render it unfit for its intended purpose. This guarantee entitles the consumer to a full or partial refund of the price.

Limitation of liability

XYPRA is committed to providing quality products and services. However, XYPRA shall not be liable for indirect or consequential damages resulting from abnormal or improper use of the products. This limitation does not apply to the consumer's mandatory legal rights, in particular the legal guarantees referred to in section 7.

Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of a dispute that has not been resolved amicably after sending us a dated written complaint (by post or email) stating the circumstances of the dispute and your requested remedy, you may refer the matter free of charge to our consumer mediator if you have received a negative written response from us or no response within two months of sending your complaint.

The consumer mediation entity selected by XYPRA is SAS MÉDIATION CONSOMMATION DÉVELOPPEMENT.

Governing law and jurisdiction

These Terms and Conditions are governed by French law. Disputes are subject to the exclusive jurisdiction of the courts of Paris, France.
